Scooter Ride Waiver, Release of Liability, and Consent

In consideration of my participation in riding scooters (the “Event”), I hereby agree and acknowledge the following:

I, the undersigned, on my behalf and on behalf of my children, spouse, guests, heirs, personal representatives, successors and assigns, release and forever discharge Skywalker 2708 Redwood, LLC (“Owner”) and any affiliates, directors, officers, employees, members, and agents (collectively the “Released Parties”) from any and all claims, demands, rights and causes of action (collectively “claims”) of any kind whatsoever which I or any of my heirs and assigns now have or later may have against any Released Party resulting from or arising out of the Event or the conditions, instructions, or procedures under which the Event is conducted, or any other cause of matter, including without limitation all such claims resulting from the negligence of any Released Party, or arising from strict product liability, or resulting from any breach of any express or implied warranty by any Released Party.

By signing this release, I and my children, spouse, heirs and assigns agree to indemnify and hold harmless any or all of the Released Parties for any injury, death or damage to myself, my property, the Released Party’s property, any other person or such other person’s property arising from the Event.

I am aware that riding or being a passenger on a scooter, moped, or motorcycle is a dangerous activity and that there are certain inherent dangers, including but not limited to hazards of roads, accidents, and actions of participants and other persons. By my participation in any event, I certify that I am aware of these inherent dangers and the safety rules of the road applicable to scooters and motorcycles. I hereby consent to and agree that I participate at my own risk and further understand that I assume all risks in participating in the event. I and my children, spouse, heirs and assigns agree to wear a helmet at all times. No scooter shall have more than one (1) rider at a time.

I hereby consent accept full responsibility for all medical expenses incurred as a result of my participation in any Event.

I understand that weather, road, or traffic conditions may make an Event more difficult.

I understand that I will be responsible for all charges related to repairing or replacing scooter(s) if lost or damaged during my stay.

SAFETY is the primary concern of the Owner. The following rules apply to all participants: 

• Riders must be 8 years of age or older  
• Passengers less than age 18 must have 
• parent/guardian consent 
• All Federal, State, and Local laws must be observed
• Helmets are required for all riders
• The Owner recommends wearing appropriate clothing and safety gear
• Participants are prohibited from riding under the influence of alcohol or drugs
